You Must Be 18 or Older

By placing an order on Topshotargets.com or submitting any quote or contact form, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not purchase products from this site. Topshot Targets reserves the right to cancel any order suspected of being placed by a minor and to require proof of age at any time. Any order placed by a minor is void and unenforceable.

Legal Eligibility to Purchase

You represent and warrant that you are legally permitted to purchase, possess, and use the products ordered under all applicable federal, state, and local laws in your jurisdiction. It is your sole responsibility to know and comply with all laws governing firearm accessories and shooting equipment in your area. Topshot Targets makes no representations regarding the legality of its products in any specific jurisdiction outside the state of Arizona. Topshot Targets reserves the right to refuse or cancel any order if, in its sole discretion, it has reason to believe applicable law prohibits the sale or shipment of any product to you.

Lawful Shooting Sports & Training Only

Topshot Targets products are designed exclusively for lawful shooting sports, recreational target practice, competitive marksmanship, and professional firearms training. By purchasing, you agree to use all products only in a safe, legal, and responsible manner consistent with all applicable laws and regulations.

Prohibited Uses

Topshot Targets products must not be used in any illegal manner, including but not limited to: use in an unsafe or unsanctioned shooting environment; use in the commission of any crime; use in furtherance of any act of terrorism or political violence; resale to any person prohibited from possessing firearm-related equipment under federal, state, or local law; use against any person or animal; or any use that endangers human life or property. Violation of this section constitutes grounds for immediate cancellation of any pending order without refund.

No Modification of Products

You agree not to alter, cut, drill (except manufacturer-specified holes), weld onto, grind, heat-treat, or otherwise modify any Topshot Targets product in any way not expressly authorized by Topshot Targets in writing. Any modification of a product: (a) immediately voids all warranties; (b) transfers all liability for any resulting injury, damage, or loss entirely to you; and (c) constitutes your express waiver of any claim against Topshot Targets arising from such modification or its consequences.

Buyer Responsibility

The buyer assumes full and sole responsibility for ensuring that all purchased products are used legally, safely, and in accordance with these Terms. Topshot Targets shall not be responsible or liable for any misuse, illegal use, unsafe use, unauthorized modification, or use in violation of these Terms of any product sold through this website.

Minimum Safe Distances

You agree to always observe minimum safe engagement distances when using steel targets. Recommended minimum: 100 yards for all calibers — rifle and handgun alike. These are minimum general guidelines only — always err on the side of greater distance. Shooting at steel targets from unsafe distances creates serious risk of injury or death from splatter and ricochet. You bear sole responsibility for determining and maintaining a safe engagement distance for your specific caliber, load, and environment.

Approved Ammunition Types

Topshot Targets steel targets are designed for use with lead-core, copper-jacketed, or copper-plated projectiles only. Do not use steel-core, armor-piercing, incendiary, tracer, or bi-metal jacket ammunition on any steel target. Such ammunition can cause dangerous ricochets, product failure, and serious injury or death. It will also void any product warranty. Always verify your ammunition type before engaging any steel target.

Caliber Compatibility

Each target is rated for specific calibers and velocity ranges. It is the buyer's sole responsibility to review and understand the caliber rating of each product before use. Using a target with calibers or loads exceeding its rating may result in product damage, dangerous fragmentation, and serious injury or death. When in doubt, contact us before purchasing.

Proper Mounting & Setup

You agree to mount and set up all targets in accordance with any instructions provided by Topshot Targets, and in a manner that allows for safe target movement and splatter deflection. Targets must be hung or mounted so they can swing freely where applicable. You are solely responsible for the integrity of your mounting setup and any injury or damage resulting from improper installation.

Inspect Before Every Use

You agree to inspect all steel targets before each use for signs of damage, cracking, pitting, deformation, or excessive wear. Damaged targets must be taken out of service immediately. Do not use a target that has been compromised by excessive impact, pitting deeper than 1/8 inch, cracking, bending, or any structural deformation. Continued use of a damaged target is dangerous and is done entirely at your own risk.

Personal Protective Equipment

You agree that all persons within the shooting environment will wear ANSI-rated ballistic eye protection and appropriate hearing protection at all times when steel targets are in use. Ricochet and splatter are inherent hazards of steel target shooting. Topshot Targets assumes no liability whatsoever for injuries resulting from failure to use proper protective equipment.

Range Rules & Compliance

You agree to comply with all applicable range rules, range safety officer instructions, and facility regulations at the location where you use any Topshot Targets product. Failure to comply with range rules or range safety officer instructions while using our products releases Topshot Targets from any liability arising from that failure.

Express, Knowing & Voluntary Assumption of Risk

YOU EXPRESSLY, KNOWINGLY, AND VOLUNTARILY ASSUME ALL RISKS associated with the purchase, ownership, possession, storage, handling, installation, and use of steel shooting targets. You acknowledge that you have had the opportunity to read and understand these Terms before purchasing, and that your purchase constitutes your free and voluntary acceptance of the specific risks described herein and all other inherent risks of steel target shooting.

Specific Risks Assumed

Without limiting the foregoing, you specifically acknowledge and assume the following risks: (a) ricochet and bullet splatter capable of causing serious bodily injury or death; (b) target fragmentation or failure under impact; (c) hearing damage from firearm discharge; (d) eye injury from fragmentation or splatter; (e) fire or property damage caused by hot projectile fragments; (f) mounting or hardware failure; (g) injury from falling or swinging targets; (h) risks arising from your own negligence or the negligence of others present at the shooting location; and (i) all other risks inherent in the activity of shooting sports. This list is illustrative and not exhaustive.

Release of Claims

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, you hereby release, waive, discharge, and forever covenant not to sue Topshot Targets, its owners, officers, members, employees, contractors, agents, and successors (collectively, "Released Parties") from any and all claims, demands, losses, liabilities, or causes of action of any kind arising out of or related to the purchase or use of any Topshot Targets product, including but not limited to claims for personal injury, death, or property damage, whether caused by the negligence of the Released Parties or otherwise.

Third Parties at Your Range

You agree that you are solely responsible for the safety of all persons present at your shooting location. You will ensure that all bystanders, range safety officers, guests, and other participants are positioned in safe locations and are informed of the risks before you engage any steel target. You accept full legal responsibility for any injury or damage suffered by any third party at your shooting location arising from your use of Topshot Targets products.

Your Obligation to Defend & Indemnify

To the fullest extent permitted by applicable law, you agree to indemnify, defend (at Topshot Targets' election), and hold harmless Topshot Targets and its owners, officers, members, employees, contractors, agents, licensors, and successors (collectively, "Indemnified Parties") from and against any and all claims, demands, suits, proceedings, liabilities, damages, judgments, losses, costs, and expenses — including reasonable attorneys' fees and court costs — arising out of or relating to: (a) your purchase, possession, use, or misuse of any Topshot Targets product; (b) your violation of any provision of these Terms; (c) your violation of any applicable federal, state, or local law or regulation; (d) any injury, death, or property damage suffered by you or any third party arising from your use of our products; (e) any claim by a third party arising from your actions or omissions; or (f) your breach of any representation or warranty made in these Terms.

Cooperation in Defense

Topshot Targets reserves the right to assume exclusive control and direction of the defense of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with Topshot Targets in the defense of any such claim and not to settle any such matter without Topshot Targets' prior written consent.

Disclaimer of All Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL PRODUCTS ARE SOLD "AS IS" AND "WITH ALL FAULTS." TOPSHOT TARGETS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY TOPSHOT TARGETS OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

No Liability for Injury or Property Damage

TO THE FULLEST EXTENT PERMITTED BY LAW, TOPSHOT TARGETS, ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS OF ANY KIND ARISING OUT OF OR RELATED TO THE PURCHASE, POSSESSION, USE, OR MISUSE OF ANY PRODUCT SOLD ON THIS SITE, INCLUDING WITHOUT LIMITATION INJURIES CAUSED BY RICOCHET, BULLET SPLATTER, TARGET FRAGMENTATION, TARGET FAILURE, MOUNTING FAILURE, OR IMPROPER USE.

Exclusion of Consequential & Other Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOPSHOT TARGETS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE — EVEN IF TOPSHOT TARGETS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT.

Cap on Liability

To the extent any liability is found notwithstanding the disclaimers and limitations in these Terms, Topshot Targets' total cumulative liability to you for all claims of any kind arising from or related to the purchase or use of our products shall not exceed the original purchase price actually paid by you for the specific product(s) giving rise to the claim.

Order Acceptance

Placing an order on our website constitutes an offer to purchase. Topshot Targets reserves the right to accept or decline any order for any reason, including but not limited to: product availability, pricing errors, suspected fraud, inability to verify eligibility, or suspected violation of these Terms. Your order is confirmed only when you receive a written order confirmation email from us.

Pricing & Payment

All prices are listed in US Dollars. We reserve the right to correct pricing errors at any time before your order ships. Payment is processed at time of order. If a pricing error is discovered after payment, we will contact you with the corrected price and provide the option to proceed at the correct price or receive a full refund.

All Sales Final

Due to the custom and made-to-order nature of our products, all sales are final once an order has been confirmed. Cancellations requested within 24 hours of order placement may be accommodated only if production has not yet begun. Custom orders, bulk orders, and quote-based orders are non-cancellable and non-refundable once production has started. See our Shipping & Returns policy for full details.

Domestic Shipping & Local Law

Topshot Targets ships only within the United States. It is your sole responsibility to confirm that the product you are ordering is legal to receive and possess in your state, county, and municipality. By placing an order, you represent and warrant that the receipt, possession, and use of the ordered product is lawful in your jurisdiction. Topshot Targets shall not be liable for any loss, cost, or legal consequence arising from your failure to comply with applicable local laws.

No Export to Prohibited Parties

You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to a US government embargo, and that you do not appear on any US government list of prohibited or restricted parties. You agree not to export, re-export, or transfer any Topshot Targets product in violation of any US export control laws or regulations, including the Export Administration Regulations (EAR) and applicable sanctions programs.

All content on this website — including but not limited to text, images, logos, product designs, graphics, layout, and source code — is the exclusive property of Topshot Targets and is protected by applicable US copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use this website for personal, non-commercial purchasing purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from this site without our prior express written permission. Unauthorized use may give rise to a claim for damages and/or constitute a criminal offense.

We do not sell, rent, or share your personal information with third parties for marketing purposes. Order and customer data is handled through Shopify's secure, PCI-compliant platform. Informal Resolution First

Before initiating any formal dispute process, you agree to contact Topshot Targets in writing at the contact information listed on this website and provide a detailed description of your dispute. Both parties agree to make a good-faith effort to resolve the dispute informally within thirty (30) days of notice. If the dispute is not resolved within that period, either party may proceed to arbitration as described below.

Binding Arbitration

EXCEPT AS PROVIDED BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PURCHASE OR USE OF ANY TOPSHOT TARGETS PRODUCT — INCLUDING THE INTERPRETATION, VALIDITY, ENFORCEABILITY, OR SCOPE OF THIS ARBITRATION PROVISION — SHALL BE RESOLVED BY FINAL AND BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time of the dispute, which are available at www.adr.org. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.

Class Action Waiver

YOU AND TOPSHOT TARGETS EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. If for any reason a dispute proceeds in court rather than arbitration, you and Topshot Targets each waive any right to a jury trial.

Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to Topshot Targets within thirty (30) days of your first purchase. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms, and disputes will then be resolved in the courts specified in Section 12.

These Terms of Service and any dispute arising out of or related to them or to any purchase from Topshot Targets shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law provisions. Any legal action or proceeding not subject to arbitration under Section 11 shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue in Maricopa County, Arizona.

Electronic Acceptance

By completing a purchase, clicking any "submit" or "buy" button, or checking any acceptance checkbox on this website, you are providing your electronic signature and entering into a binding legal agreement. You acknowledge that such electronic acceptance is legally equivalent to a handwritten signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and the Uniform Electronic Transactions Act (UETA) as adopted in Arizona (A.R.S. § 44-7001 et seq.).

Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect and shall not be affected by the invalidity or unenforceability of any other provision.

No Waiver

Topshot Targets' failure to enforce any provision of these Terms on any occasion shall not constitute a waiver of its right to enforce that provision or any other provision in the future. No waiver of any term shall be effective unless made in writing and signed by an authorized representative of Topshot Targets.

Entire Agreement

These Terms of Service, together with any policies referenced herein, constitute the entire agreement between you and Topshot Targets with respect to the purchase and use of our products and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. No representation, promise, or agreement not expressly contained in these Terms shall be binding on Topshot Targets.

No Third-Party Beneficiaries

These Terms are for the sole benefit of you and Topshot Targets and do not create any third-party beneficiary rights. Nothing in these Terms shall be construed to give any other person or entity any legal or equitable right, remedy, or claim under these Terms.

Force Majeure

Topshot Targets shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government actions, labor disputes, supply chain disruptions, or carrier failures. In such circumstances, Topshot Targets will make reasonable efforts to notify you and fulfill your order as soon as reasonably practicable.

Topshot Targets reserves the right to update or modify these Terms of Service at any time. Changes will be effective upon posting to this page. The "Last Updated" date at the top reflects when changes were last made. Your continued use of this website or purchase of products after any change constitutes your acceptance of the revised Terms. We encourage you to review this page before each purchase.
